Terms of Service

These terms govern use of the SepticTrack website and services.

1. General

These terms and conditions of service, together with SepticTrack’s Privacy Policy and service arrangements, govern use of the website, services, features, content and applications operated by SepticTrack and provided to subscribers.

Please read these Terms of Service carefully before using the services. If you do not agree, you must not use the services.

Using the services in any manner constitutes acceptance of these Terms of Service and any other operating rules, policies and procedures published by SepticTrack from time to time.

2. Severability

If any provision of this agreement is prohibited by law or held unenforceable, that provision will be severed and the remaining provisions will continue in full force.

3. Limitation of liability

To the maximum extent permitted by law, SepticTrack, its directors, employees, agents, partners, suppliers and content providers are not liable for indirect, incidental, special, consequential, compensatory or punitive damages arising from use of the services.

4. Warranty disclaimer

The services and content are provided “as is” and “as available” without warranty of any kind, subject to rights that cannot be excluded under Australian Consumer Law.

5. Indemnification

You agree to defend, indemnify and hold harmless SepticTrack and its related parties from liabilities, claims and expenses arising from misuse of the services, breach of these terms or breach of applicable law.

6. Billing

Invoices are issued in accordance with applicable service fees. Payment must be made by the stated due date.

7. Service fees

Certain services may carry setup, subscription or usage fees. Fees are payable according to the agreed service arrangement.

8. Failure to pay

SepticTrack may temporarily deny service or terminate access where charges remain unpaid when due.

9. Backups and data loss

Use of the service is at your own risk. Subscribers are responsible for maintaining appropriate backups of files and data where applicable.

10. Content

Subscribers are responsible for content stored or submitted through the SepticTrack service.

11. Governing law and jurisdiction

These terms are governed by the laws of Victoria and the Commonwealth of Australia. Disputes are subject to the courts of Victoria and Australia.

12. Dispute resolution

Parties agree to first attempt to resolve disputes in good faith by written notice and reasonable opportunity to respond before commencing legal proceedings.
